§ 2 Principles of data processing

The legal basis for this processing is our legitimate interest pursuant to Art. 6 (1) lit. f GDPR. Our legitimate interest is the processing of your request. You can object to the storage of your personal data at any time. In such a case, however, the conversation cannot be continued. c. Storage period
The data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected. For personal data sent by e-mail, this is the case when the respective conversation with you has ended. This is to be assumed if it can be inferred from the circumstances that the matter concerned has been conclusively clarified.

5. social plugins

A social wall from Juicer is integrated on this website. The Juicer system offers the possibility of displaying social media activities bundled in a social feed and integrating this as a social wall on the website. It is possible to integrate posts from Instagram, Twitter and numerous other social media channels based on hashtags or, alternatively, to display all posts from an account (Instagram, Twitter, etc.) on the social wall. The Social Wall can be accessed by anyone, including people who are not registered on Instagram, Twitter, etc. The Social Wall is operated by Juicer. The operating company of Juicer is Juicer.io, 1515 7th Street, #424, Santa Monica, CA 90403.

Juicer and third-party providers who work together with Juicer operate - according to their own statements - in a GDPR-compliant manner. Juicer has not at any time, and will not at any time:
• store or collect personal data of users who view the Juicer feed (social wall) on a page.
• Share user data apart from cookies that enable the user to better use the system. In doing so, Juicer collects a minimum of data and treats it discreetly.

6. google maps

a. Type and scope of data processing
This website uses the mapping service Google Maps via an API. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. 
In order to use the functions of Google Maps, it is necessary to store your IP address in addition to other information. This information is usually transferred to a Google server in the USA and stored there. Google uses such information to connect it with other information about the user, to build profiles and for analysis and advertising purposes. Information is only transferred to Google when the Google Maps map is activated. The map is marked with a corresponding notice. The transmission of data to Google can be interrupted at any time by making the appropriate setting in the cookie banner.

Google is an international organisation. It is therefore possible that your personal data may be transferred to the USA. There are currently no suitable guarantees for data transfer to the USA. There are restrictions on the protection of personal data resulting from the fact that, under US law, security authorities can access data transferred from the EU to the US and use it without restriction to what is strictly necessary. Data subjects may not be able to take legal action against such use if they are not US citizens. A transfer therefore only takes place with your consent in accordance with Art. 49 para. 1 lit. a GDPR by activating the map from Google Maps. You can revoke your consent at any time by making the appropriate setting in the cookie banner.

b. Legal basis
The legal basis for the processing is your consent given by activating the map of Google Maps according to Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time by making the appropriate setting in the cookie banner. The cookie banner can be opened by pressing the "Change your consent" (“Einwilligung ändern”) button in the privacy policy under point 4 a (How can I switch off or remove cookies). There you can deactivate the transmission of data under Einstellungen/Werbung/Google Maps.

c. Storage period
We do not store any of your data in connection with the use of the map. Data will only be transmitted to Google when the map is activated and will be stopped as soon as you have revoked your consent to this by means of a corresponding setting in the cookie banner.

§ 4 Disclosure of data

The transfer of data to third parties can be found in the respective chapter on data processing. In addition, the following generally applies: We will only pass on your personal data to third parties if:
• you have given your express consent to this in accordance with Art. 6 (1) lit. a GDPR
• this is legally permissible and necessary for the fulfilment of a contractual relationship with you in accordance with Art. 6 (1) lit. b GDPR
• there is a legal obligation to disclose data pursuant to Art. 6 (1) lit. c GDPR
• the disclosure is necessary in accordance with Art. 6 (1) lit. f GDPR for the protection of legitimate business interests, as well as for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.

Outside Banijay:

a) Processors
Service providers we use to provide services, for example in the areas of technical infrastructure and maintenance for our offering or content provision. These processors are carefully selected and regularly reviewed by us to ensure that your privacy is protected. The service providers may only use the data for the purposes specified by us. External service providers who process data on our behalf are strictly bound by contract in accordance with the relevant data protection regulations and do not count as third parties under data protection law.

b) Public authorities
Authorities and state institutions, such as public prosecutors' offices, courts or tax authorities, to which we may have to transfer personal data in individual cases for legally compelling reasons.

Transfer to a third country:
If a transfer of data to organisations whose registered office or place of data processing is not located in a member state of the European Union or in another state party to the Agreement on the European Economic Area takes place, we will ensure before the transfer by contractual arrangements or other recognised instruments that your personal data are adequately protected and securely processed, unless an adequacy decision of the Commission assures an adequate data protection standard for that country.

The storage period of personal data can be found in the respective chapter on data processing. In addition, the following generally applies: We store your personal data only as long as this is necessary for the fulfilment of the purposes or - in the case of consent - as long as you have not revoked your consent. In the event of an objection, we will delete your personal data unless its further processing is permitted under the relevant legal provisions. We will also delete your personal data if we are obliged to do so for legal reasons.

§  6 Hyperlinks

Our website contains so-called hyperlinks to websites of other providers. When activating these hyperlinks, you will be forwarded from our website directly to the website of the other provider. You will recognise this by the change of URL, among other things. We cannot accept any responsibility for the confidential handling of your data on these third-party websites, as we have no influence on whether these companies comply with data protection regulations. The following rights arise from the GDPR for you as a data subject of a processing of personal data:
• Pursuant to Art. 15 GDPR, you may request information about your personal data processed by us. In particular, you can request information about the processing purposes, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, about a transfer to third countries or to international organisations, as well as about the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details.
• Pursuant to Art. 16 GDPR, you can immediately request the correction of incorrect or the completion of your personal data stored by us.
• Pursuant to Art. 17 GDPR, you may request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims.
• Pursuant to Art. 18 GDPR, you may request the restriction of the processing of your personal data insofar as the accuracy of the data is disputed by you, the processing is unlawful, we no longer need the data and you object to their deletion because you need them for the assertion, exercise or defence of legal claims. You also have the right under Article 18 of the GDPR if you have objected to the processing in accordance with Article 21 of the GDPR.
• Pursuant to Art. 20 GDPR, you may request to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or you may request that it be transferred to another controller.
• Pursuant to Art. 7 (3) GDPR, you may revoke your consent once given to us at any time. This has the consequence that we may no longer continue the data processing based on this consent for the future.
• Pursuant to Art. 21 GDPR, you have the right to object to the processing of your personal data on the basis of legitimate interests pursuant to Art. 6 (1) lit. f GDPR, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. We are committed to protecting your privacy and treating your personal data confidentially. In order to prevent manipulation, loss or misuse of your data stored with us, we take extensive technical and organisational security precautions, which are regularly reviewed and adapted to technological progress. However, we would like to point out that, due to the structure of the Internet, it is possible that the rules of data protection and the above-mentioned security measures are not observed by other persons or institutions not within our sphere of responsibility.
